The personal information (hereinafter “Information”) that you entrust to us is essential to our business relationship with you. We know it is valuable, and we are committed to protecting it.

That is why we have adopted this policy, in which we describe our practices aimed at protecting your Information and your privacy. This policy applies to the collection, use, and disclosure of Information you provide to us. It applies for as long as we hold your information, including after the end of our business relationship.

2. What type of information may we collect and how?

2.1 Information we may collect

Identification information

  • Name
  • Date of birth
  • Marital status
  • Contact details
  • Email address
  • Information found on identification documents (driver's licence, passport, Social Insurance Number*)
  • Employment and income
  • Information we hold about you as an authorized representative, director, officer, or shareholder
  • Any other information requested through our mortgage brokerage agreement

* Failure to provide certain mandatory information, such as the Social Insurance Number (SIN), may prevent us from providing certain services, including investment or financing. It is also required for tax purposes, particularly if an account generates income.

Information to confirm your identity

  • Signatures
  • Information about your financial accounts. We do not use biometric data.

Financial information to assess eligibility

  • Income, salary, and balances
  • Products and investments and their terms (e.g., term, repayment frequency, limits, rates, maturity, etc.)
  • Creditworthiness and credit score
  • Employment, financial, and criminal history
  • Any other relevant information related to your personal financial situation (e.g., real estate assets, personal debts, guarantees, financial obligations, etc.)

Transaction information

  • Loan instructions and debt service capacity
  • Intended use of borrowed funds and property description
  • Financing history and repayment behaviour

  • Reason for doing business with us
  • Language and communication preferences
  • Information we may generate about you
  • Information about other individuals (authorized representative, secondary cardholder, beneficiaries, spouse or common-law partner, dependents, or other persons linked to your account or services, when legally permitted)

* If you provide information about another person, we assume you are authorized to do so and have obtained their consent.

Information for training, quality control, identification, security, or consent tracking purposes

  • History and transcripts of calls, video conferences, and chats

Digital and device information

  • We do not store any digital or device-related information in our systems

IMPORTANT: We limit the collection of information to what is necessary to serve you and comply with legal obligations.

2.2 How we collect your information?

We may collect information directly from you when you interact with us in person, by phone, in writing, or through our portal or online forms. We may also collect information indirectly from:

  • entities related to your products and services
  • financial institutions or lenders, insurers
  • brokers or other securities-related participants
  • credit reporting and evaluation agencies
  • publicly available sources or registries
  • regulatory or self-regulatory organizations
  • business partners
  • our website, digital platforms, or social media

3. How we use and share your information

3.1 Use of your information

To provide you with tailored products and services:

  • Identify yourself, update your information, and verify the accuracy of the information provided
  • Assess your financial situation and your creditworthiness
  • Assess your eligibility for products and services, or ensure that our advice, products, and services are suitable for you
  • Allow our exempt-market broker to establish your investor profile, your financial needs and objectives, as well as your investment strategies
  • Establish, manage, administer, and maintain the requested products and services
  • Personalize your customer experience, particularly through analysis of your profile, your transactions, and other information, including to:
    • Better understand you and your needs
    • Better advise you through the analysis of your needs and preferences

Communication with you using the contact information you have provided:

  • Mail, email, telephone communications

Conducting our business operations:

  • Prevent, detect, and control fraud, as well as unauthorized or illegal activities (including money laundering and cyber threats)
  • Conduct due diligence reviews of our operations in anticipation of a business transaction
  • Manage risk, including credit and business risk, and comply with applicable laws and regulations
  • Confirm your instructions, ensure service quality, and train our staff, including through data derived from our interactions with you
  • Conduct studies and data analyses to generate statistics, improve efficiency, enhance our products and services, and develop new offerings

3.2 To whom may we disclose your information

The disclosure of your information to third parties for legitimate purposes is sometimes necessary. For example, it may be required by law, necessary to protect your interests in the event of fraud, or necessary to allow you to participate in a program with a partner or to receive services on our behalf. At all times, we are committed to limiting the information disclosed to what is necessary and obtaining your consent when required.

We ensure the integrity, security, and confidentiality of your information. Under no circumstances do we sell your information to third parties.

We may disclose your information to:

  • Hive Mortgage and Vertigo, for identification purposes, for financial information for compliance purposes, and to facilitate day-to-day management of your files
  • A person acting on your behalf or at your request, such as an insurance broker
  • A financial institution, notary, lender, exempt market dealer broker, or credit reporting and assessment agency
  • An insurer or an agent acting on our behalf
  • A merchant, a partner with whom we collaborate to offer optional products and services, a payment system, or a clearing or settlement system
  • A person holding a joint file with you or otherwise involved in your relationship with us
  • Our electronic client system provider, Scarlett
  • Third parties, where disclosure is required in the context of legal proceedings
  • A regulatory, governmental, or self-regulatory authority
  • Any person authorized to receive the information under applicable law
  • Third parties involved in the completion of a business transaction
  • Digital platforms with which we may share your name and contact information (e.g., your email address) in order to enable targeted advertising on their platforms (see your right to opt out in Section 5.2)

3.3 Service providers

We carefully select our service providers. They fall into the following categories:

  • Technology services (applications, data centres, data storage and backup, hosting services, maintenance, and support services)
  • Professional services
  • Financial and payment services

All service providers are required to use your information solely for the purposes set out in their service agreements and to protect it at a level equivalent to the protection we provide. We ensure that our service providers maintain a strong reputation in their handling of personal information.

4. When do we need your consent?

We only use your information with your consent or where permitted by law. We obtain your consent for the collection, use, and disclosure of your information:

  • When you open a file or enter a business relationship with our company
  • When we need to use your information for a purpose other than those for which consent was originally obtained

We do not obtain your consent at every interaction. For example, if you hold a mortgage loan, we may consider that you consent to being contacted regarding renewal discussions.

In addition, consent is not required in certain situations provided for by law, such as:

  • Compliance with a court order or other binding legal request
  • Debt collection
  • Investigating a breach of contract or law
  • Preventing, detecting, or stopping fraud

5. Your rights and how to exercise them

5.1 Right to provide or refuse your information

Your information belongs to you. Subject to legal, business, or contractual requirements, you have the right to withdraw your consent to the collection, use, or disclosure of your information. We will process your request as promptly as possible.

However, certain information is essential for us to provide certain products and services. If you refuse to provide such information, it may be difficult or impossible to maintain a business relationship with you or to offer certain services.

5.2 Right to refuse certain uses or disclosures of your information

You may refuse to allow us to use or disclose your information for the following purpose:

Sharing your financial information within Hive Mortgage

We may disclose your financial information within the entities of the Hive Mortgage group in order to facilitate the relationship and simplify interactions with you. This allows, among other things:

  • To better serve you by maintaining a complete view of your files within Hive Mortgage, where permitted by law (for example, by accessing your financial profile more quickly when applying for a new loan or subsequent product)
  • To analyze your financial situation in order to assess your eligibility for offers, promotions, and certain products and services that may better meet your needs, where permitted by law

You may request access to the information we hold about you or request that it be disclosed to you, except where restricted by law.

Right to correct your information

You may and are expected to correct any inaccurate information about you. To ensure high-quality service, it is essential that your information is accurate and complete. We rely on you to inform us of any changes so that we can maintain accurate records.

6. Security measures for retaining your information

6.1 Limited retention period

We retain your information in digital form only for as long as necessary to fulfill the purposes for which the information was collected or for as long as required by law. The purpose, nature, and sensitivity of the information are taken into account when determining retention periods.

Hive Mortgage is subject to numerous legal obligations regarding the retention of information (for example, under banking, tax, and anti–money laundering laws). Generally, to comply with these obligations, information relating to your client profile (such as your name, address, and date of birth) will be retained for the duration of your relationship with us and for a period of seven years following the end of that relationship. In addition, we will retain your transactional information for seven years after its execution.

Certain exceptions may apply and require longer retention periods, for example in the case of disputes or claims. In such cases, your information may be retained for up to ten years after the end of the proceedings. When your information is no longer required, we take steps to ensure it is securely destroyed.

6.2 Storage locations

Hive Mortgage, its service providers, and other third parties to whom your information is disclosed under this policy may, to the best of our knowledge, not operate outside Quebec and Canada.

6.3 Information security program

We make significant efforts to protect your information against loss, theft, and unauthorized access, use, or disclosure, as well as any other breach of the protection of such information. We have implemented a security program and an information technology governance and cyber-risk policy to keep pace with the constantly evolving threats to information security. The measures adopted within our security program include:

  • Protecting infrastructure through secure access to our premises and secure locations for our equipment, etc.
  • Limiting access to your information so that only employees who require it for their work may access it
  • Managing passwords and implementing firewalls

You also play a role in protecting your information. We encourage you never to disclose your passwords. Our employees do not have this information and will never request it from you. Avoid transmitting sensitive information by email.

This policy is supplemented by specific data processing conditions contained in our various contracts, depending on the nature of your business relationship with Hive Mortgage.
